Terms and conditions
The rules for booking and taking a safari with us, written in plain English.
Last updated 2026-10-17
1. Who we are
These terms apply to every safari, day trip, transfer and accommodation booking made with Amboseli National Park Safaris, a tour operator based in Nairobi, Kenya. You can reach us on WhatsApp or call +254 725 431 452, or write to bookings@amboselinationalparksafari.com. In these terms, "we", "us" and "our" mean the business named above, and "you" means the person making the booking and everyone travelling on it.
By asking us to confirm a booking, or by paying a deposit, you accept these terms and our booking and cancellation policy. You also confirm that you have the authority to accept them for everyone in your group.
2. Making a booking
We take bookings through WhatsApp and email. There is no online checkout on this website, and the Plan My Safari form only opens WhatsApp with a message ready for you to send.
- Quote. We send a written plan and price by WhatsApp or email. A quote is valid for seven days. Availability and rates are not held until we receive your deposit.
- Confirmation. Your booking is confirmed only when we have received your deposit and sent you written confirmation (by WhatsApp or email). Until then, nothing is reserved for you.
- Accuracy. Please check names, dates, group size, ages and special requests in the confirmation and tell us straight away if anything is wrong. Names must match passports and ID.
- Website information. Package pages describe typical safaris. Your written itinerary and quote are the final record of what you have booked. If the two differ, the written itinerary applies.
3. Prices and payment
Prices are quoted per person in US dollars unless your quote says otherwise. The deposit, the balance and the accepted payment methods are set out in the booking and cancellation policy. Once your deposit is received, your price is fixed, except where a government body or park authority changes a fee, tax or levy that applies to your trip. If that happens, we pass on the difference and show you the details. We will never ask you to pay to an account or number that we have not confirmed in writing from our official WhatsApp number or email address.
4. What is included
Your written itinerary lists what is included and what is not. Anything not listed is an extra. Optional activities such as hot air balloon flights, cultural visits and bush meals are provided by independent operators and carry their own terms and fees, which we tell you about before you book.
5. Park fees
Park and conservancy fees are set by the Kenya Wildlife Service and the landowners, not by us. We confirm the fees that apply to your dates when we quote you, and say whether they are included. Fees that have been paid to the authority for your dates cannot normally be recovered if you cancel or change.
6. Suppliers
We arrange your driver-guide, transport, accommodation and activities. Some services are delivered by independent suppliers such as lodges, camps, airlines and park authorities. We choose suppliers with care and we act quickly to put things right if a supplier lets you down, but each supplier's own terms apply to its service. We show you any stricter supplier terms in your quote.
7. Changes we may make
Wildlife, weather, road conditions, park closures and supplier availability can change plans. We may adjust routes, timings, vehicles or guides for safety or to give you a better safari. If we must change your accommodation, we offer an equal or better alternative. If we make a major change before you travel, such as a different park or a change of more than one night, we offer you the choice of the new plan or a refund as described in the booking and cancellation policy.
8. Your responsibilities
- Documents. You must hold a passport valid for the period Kenya requires and any visa, electronic travel authorisation (eTA) or other entry permission that applies to your nationality. Kenya's entry rules change, so check them with the Kenyan immigration authorities or your nearest Kenyan embassy before you travel.
- Health requirements. You are responsible for any vaccination certificates the authorities require, including proof of yellow fever vaccination if you arrive from a country where it is required. We recommend that you ask a doctor or travel clinic about malaria prevention and routine vaccinations well before you travel.
- Health information. Tell us before you book about any medical condition, mobility limit, allergy, pregnancy or dietary need that could affect your safari. We will say honestly whether we can cater for it. Safaris involve long drives on rough roads, and medical help can be hours away.
- Behaviour. Follow your guide's instructions and park rules at all times. Treat guides, drivers, staff and other guests with respect. We may end your participation, without refund, if your behaviour puts others, wildlife or staff at risk.
- Children. Children must be supervised by an adult at all times. Age limits for some activities are set by the providers, and we tell you about them at booking.
9. Travel insurance
We strongly recommend, and for some activities suppliers may require, travel insurance that covers cancellation, curtailment, medical treatment, emergency evacuation and loss of baggage and belongings. We do not sell insurance. If you travel without cover, you carry those costs yourself.
10. Safety and wildlife
You will be close to wild animals in their own habitat. Their behaviour is unpredictable, and weather, terrain and distance from medical care add risk. Our guides are experienced, but no safari is free of risk and you accept the normal risks of wildlife travel. Park rules apply to everyone, including staying in the vehicle except at designated places, keeping to the speed limit, keeping a safe distance from animals, never feeding wildlife and keeping noise low. Single-use plastic is banned in Kenya's protected areas, and we ask you to carry out all rubbish. Your guide may stop or change an activity at any time if it is not safe.
11. Events outside our control
We are not responsible for failing to perform, or for delay in performing, any part of your safari if the cause is outside our reasonable control. Examples are severe weather, flooding, fire, natural disaster, epidemic or public health measures, war, terrorism, civil unrest, strikes, government action, road or park closures, aircraft grounding and failure of public utilities or communications. In these cases we will work with you to rearrange your safari. If we cannot, we refund the parts of your safari that are not delivered and that suppliers refund to us, after deducting costs we have already paid and cannot recover.
12. Our liability
We will arrange and provide your safari with reasonable care and skill. If we do not, you may be entitled to compensation under Kenyan law. Subject to the points below, our total liability to you for any claim connected with your safari is limited to the amount you paid us for the part of the safari affected.
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that the law of Kenya does not allow us to limit. Your statutory rights as a consumer, including under the Consumer Protection Act, 2012, are not affected.
We are not liable for loss or damage caused by events described in section 11, by your own actions or failure to follow instructions, or by acts of independent suppliers that we could not reasonably have prevented. We are not liable for loss of valuables, cash, cameras, phones or other belongings left in vehicles, rooms or tents, so please keep them with you or in the lodge safe.
13. Complaints and disputes
- On the trip. Tell your guide or message us on WhatsApp straight away, so we can fix the problem while you are still travelling.
- After the trip. If you are still unhappy, send a written complaint to bookings@amboselinationalparksafari.com within 30 days of the end of your safari, with your booking details and what you would like us to do. We reply within 14 days.
- Talking it through. If we cannot settle it together, we will try mediation in good faith before either of us goes to court. You may also complain to the Tourism Regulatory Authority, which licenses tour operators in Kenya.
14. Governing law
These terms and any dispute connected with your booking are governed by the laws of Kenya. If a dispute cannot be settled by agreement or mediation, the courts of Kenya have jurisdiction, and the parties may agree in writing to refer the dispute to arbitration under the Arbitration Act, 1995.
15. Our website and your data
This website is for general information. We take care to keep it accurate, but it may contain errors, and package details and availability can change. The text, photos and design belong to us or are used with permission, and you may not copy them for commercial use without our written consent. How we handle your personal data is explained in our privacy policy.
16. Changes to these terms
We may update these terms from time to time. The version in force on the day we confirm your booking applies to that booking. If any part of these terms is found to be unenforceable, the rest stays in force.
